Front page Caleb Buxton to Jn. Carrington. Last Will. Dated 14th Dec. 1793 In the Name of God Amen. This is the last Will and Testament of me Caleb Buxton of the Parish of Smalley in the County of Derby Yeoman. First it is my Will and mind and I do hereby order and direct that all my just debts and Funeral expences shall be fully paid and satisfied so soon as conveniently may be after my decease and subject thereto I do give and dispose of all my Estate (being personal) in manner following (that is to say) Whereas I have in expectation a sum of money or other property being the personal Estate of my son Joseph Buxton lately deceased which by virtue of the statute of distribution may fall into my hands or in my right into the hands of my Executor hereinafter named, therefore I do hereby give and bequeath all such sum or sums of Money or other property as aforementioned or any security or securities for money together with all my Personal Estate rights claims dues debts and demands whatsoever or wheresoever to be equally divided among my Grandchildren in manner following (that is to say) my Grand-daughter Betty Buxton now of Shipley the daughter of my son Samuel Buxton deceased, and also all my Grandchildren the Issue of my daughter Rachel, the wife of John Carrington of Smalley aforesaid or as many as shall be living at my decease and to every one of them share and share alike to be paid to them by my Executor severally and respectively when they shall respectively attain the age of Twentyone years, but if any of my Grandchildren as above mentioned shall die before they attain the age of Twentyone years then I hereby do order and direct that such dividend or share of my Effects which would have been the share of such deceased Grandchild shall become the property of my Daughter Rachel Carrington or her proper representative. Also I do hereby appoint my son in law John Carrington of Smalley aforesaid to be the only and sole Executor of this my last Will and Testament and I do hereby order and direct that my son in law John Carrington aforesaid shall receive for his own proper use and benefits all the Interests Issues and profits of all my Personal Estate that may arise or grow due thereon from the time of my decease to the time of the payment of the several and respective shares to my Grandchildren as aforesaid. And I do hereby order and direct that my son in law John Carrington shall indemnify and save and retain to himself all such costs Charges and Expences which he may be put unto and which may be occasioned by the Execution of this my last Will and Testament. And I do hereby revoke and make void all former and other Wills by me at any times heretofore made and do declare these presents only to be and contain my last Will and testament. In Witness whereof I the said Testator Caleb Buxton have to this my last Will and Testament set my hand and seal this fourteenth day of December in the Year of our Lord One Thousand seven Hundred and Ninety three. Signed in own hand Signed Sealed published and declared by the said Testator Caleb Buxton as and for his last Will and Testament in the presence of us; who at his request in his presence and in the presence of each other subscribed our names as Witnesses thereto. John Smith Sam. Birch First Codicil on separate small sheet. I leave my son Robert Buxton five Pounds and I declare this to be a Codicil to my Will. Caleb Buxton. Signed in own hand March 17th. 1794 Witnesses Henry Galey and John Latham Second Codicil at the end of the second page of the Will I do hereby give and bequeath to my son Robert Buxton the sum of Five Pounds and I also hereby appoint my said son Robert Buxton to be joint Executor with my son in law John Carrington as named in my last will contained on this sheet of paper. And I do also hereby declare this to be a Codicil to my last Will and Testament. Dated this Twenty seventh day of March One Thousand seven Hundred and Ninety four. Caleb Buxton. Signed in own hand Witnesses John Smith Sam. Birch 14 June 1798 Robert Buxton the son and Executor named in this second Codicil was duly sworn to the both of this Will and Codicil as usual and also that the whole Goods Chattles and Credits of the said deceased do not amount in value to the sum of one hundred pounds power reserved to John Carrington the Executor named in the said Will when he shall apply for the same. Farquhar Before me G Coote The Testator was late as described and dead in January last. Proved at London with two Codicils the 19th Day of June 1798, before the Worshipful Charles Cook Doctor of Law and Surrogate by the Oath of Robert Buxton the Son and Extor. named in the second Codicil to whom Admon was granted having been first sworn duly to administer, power reserved of making the like grant to John Carrington the Extor named in the Will when he shall apply for the same. |
